This will depend on the severity and degree of labour intervention in your business. If your enterprise is largely attritonal and anatagonistic you can expect a more intense liasom and presence from us. The inverse is true if yoir enterprise is less attritional and antagonistic. Factirs such as union involvement; size of the business; sectiral determination etc will all also play a determining factor in our day to day involvement with the business.
First of all we will not malign any legal practitioner or the industry. In our experience we have found that most commercial lawyers do not have the niched understanding of day to day labour relations especially in the SMME sector. There is often a disconnect between the fancy court processes and framework and that of the rugged often unpolished landscape of your business. At Gente we understand the ugly side of labour relations and through our years of experience have found that engaging and mastering concepts at a basic level more often than not translates to better success for your business.
While what we offer and do is not an exact science we do base our relevance on certain factors. These factors include: how big is your business; is your business industry regulated; does your business have a decentralized HR or similar function; are you an SMME with very slim margins for man power and expenses. Yes. Our services will largely depend on your needs and budgetary constraints. This will be determined after a due and proper sit down with your management team and decision makers after which the best model or service for your business will be agreed upon.
We work on a mutual benefit system. This means that once a fee and service has been agreed upon we work to this until such time that you no longer wish to continue with us or there is a supervening or overwhelming reason as to why we cannot continue with you. We do this to grant you freedom of choosing and indeed halting your service providers without becoming entangled in red tape.
No. We aim to work with minimal disruption to your business. That said, we would need to have a minimum amount of support and man power depending on the scope and size of the issue at hand eg availability of witnesses in a disciplinary hearing etc.
This is typically done by the business bookkeeper or accountant or similar. We are not accountants or financial services providers however we do provide an oversight with the relevant parties to ensure that all statutory and prescribed industry submissions are handled.
Unfortunately but categorically no. We are not admitted attorneys or advocates. Should the need arise to litigate in court we will liaise with your preferred attorney/legal counsel and act strictly at their direction and or recommend an attorney or counsel for you should you require.
We are not immigration lawyers. Should you employ foreign nationals we will together with management strive to ensure that such employees are correctly documented. We will also develop and implement strict company policies regulating foreign nationals and ensure that they are well employed and operating well within the confines of the Immigration Act and other relevant legislation.
